End User License Agreement (EULA)

Welcome to Vigil.

By using this application, you agree to the following terms and conditions. If you do not agree to these terms, do not install or use the Application.

1. Nature of the Application

            Vigil is designed to be a supportive tool to assist users and caregivers. It is NOT a certified medical device, diagnostic tool, or a replacement for professional human care, supervision, or emergency services.
        

The Application relies on device sensors, network connectivity, and operating system behaviors, all of which are subject to inaccuracies, delays, or failures outside the developer's control.

2. No Liability for Emergencies or Diagnostics

Because Vigil is not a certified diagnostic tool, any alerts, logs, or diagnostic information provided by the Application should be treated as informational only. TemperedCode is not liable for:

Failure to trigger an SOS alert or notify a caregiver.
Inaccurate sensor readings, location data, or false alarms.
Any injury, health deterioration, or damages resulting from reliance on the Application in place of human supervision or medical professionals.

3. Data and Synchronization

Vigil uses cloud services (e.g., Firebase) to synchronize data between users and authorized caregivers. While we implement security measures, we are not responsible for data loss, service interruptions, or unauthorized access resulting from compromised user credentials or third-party platform outages.

4. Proper Usage

You agree to use Vigil only as intended and in compliance with all local laws. You must ensure you have the necessary consent from the individual being monitored (the senior/user) to track their location and sensor data, if applicable.

5. License Grant

TemperedCode grants you a personal, non-exclusive, non-transferable, limited license to use the Application on devices that you own or control, strictly in accordance with these terms.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TEMPEREDCODE BE LIABLE FOR ANY DIRECT, SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR PERSONAL INJURY, LOSS OF LIFE, LOSS OF PRIVACY, OR DEVICE FAILURE) ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE APPLICATION.

7. Indemnification

You agree to indemnify and hold harmless TemperedCode and its developers from any claims, losses, or damages, including legal fees, resulting from your misuse of the Application, failure to respond to an emergency, or reliance on incorrect logs/information provided by the Application.
